Terms of Service

Welcome to Milivault ("we", "us", "our"). These Terms of Service ("Terms") govern your use of the Milivault website and any related services (collectively, the "Service").

By accessing or using Milivault, you agree to these Terms. If you do not agree, please do not use the site.

1. What Milivault Is

Milivault is an independent website run by Keenan Nilson. The site aggregates information about militaria items and provides tools such as product lists, saved items, comparisons, and case studies to help collectors better understand pricing and trends.

Milivault does not buy or sell items directly. We are not a party to any transaction between you and any third-party dealer, auction house, or private seller.

2. Eligibility

Milivault is intended for collectors and enthusiasts worldwide. By using the Service, you confirm that:

  • You are legally able to use the site under the laws of your country, and
  • If you create an account, you provide accurate information and keep your login details secure.

The site is not designed for children under 13. If you are under 13, please do not create an account or submit personal information.

3. Accounts and Security

To use certain features, you may need to create an account.

You agree to:

  • Provide accurate and up-to-date information when registering
  • Keep your password and login details confidential
  • Be responsible for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or are used in a way that harms the Service or other users.

4. User Content

Milivault may allow you to create or upload content, including:

  • Saved items and comparisons
  • "My Collection" entries and images
  • Comments or chat messages (now or in the future)

4.1 Your rights

You keep ownership of the content you create or upload. However, by submitting content to Milivault, you grant us a non-exclusive, worldwide, royalty-free license to use, display, store, and reproduce that content as needed to operate and improve the Service (for example, to show your collection items to you, display comments, or back up data).

4.2 Your responsibilities

You are responsible for the content you submit. You agree not to upload or share content that:

  • Is illegal, hateful, threatening, or harassing
  • Violates someone else's privacy or intellectual property
  • Contains spam or attempts to advertise unrelated products/services
  • Includes sensitive personal information that shouldn't be shared publicly
  • You confirm that you own or have permission to upload any images you submit, and that they do not infringe on anyone else's copyright, trademark, or other intellectual property rights

We may remove or restrict content that, in our judgment, violates these Terms or applicable law.

4.3 Indemnification

You agree to indemnify and hold harmless Milivault and its owner (Keenan Nilson) from and against any claims, demands, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) content you submit, upload, or share through the Service; (b) your use of the Service; (c) your violation of these Terms; or (d) your violation of any law or the rights of any third party (including intellectual property or privacy rights).

5. Use of the Service

You agree to use Milivault in a lawful and reasonable manner. In particular, you agree not to:

  • Try to interfere with or disrupt the Service, servers, or networks
  • Attempt to gain unauthorized access to any part of the Service or other accounts
  • Use automated systems (bots, scrapers, etc.) to access or copy the site at a scale or frequency that could harm performance or stability
  • Reverse engineer or attempt to extract the source code of the Service (except where allowed by law)
  • Use the Service for any illegal purpose or in violation of any applicable law or regulation

Reasonable personal use, including normal browsing and occasional research, is fine. If you are interested in larger-scale data access for research or commercial use, please contact us first.

6. Information, Accuracy, and No Guarantees

6.1 Beta Service; Changes and Availability

Milivault is currently provided in beta. Features may change, be added, removed, or discontinued at any time. The Service may experience downtime, delays, data resets, or errors. We do not guarantee that any feature will remain available, that historical data will remain complete, or that the Service will operate without interruption.

Milivault relies heavily on data from third-party sites and historical listings. While we try to keep information reasonably accurate and up to date, we cannot guarantee:

  • That prices, availability, or descriptions reflect the current market or the exact state of any item
  • That any dealer or seller is honest, reliable, or competent
  • That any item is original, authentic, or fairly priced

Case studies, price ranges, "fair value" estimates, comparison tools, historical analysis features (such as helmet configuration checkers), and other analysis on Milivault are informational opinions only. Some features may use automated analysis or AI-assisted tools to provide estimates or insights. These are computational outputs, not expert opinions or authentications, and should be treated as starting points for your own research.

They are not guarantees, appraisals, or professional advice. You should always do your own research and make your own decisions before buying or selling anything.

Milivault is not responsible for any loss or damage arising from your reliance on information on the site, including missed deals, overpaying, underpricing, or disputes with sellers or buyers.

7. Donations, Memberships, and Payments

From time to time, Milivault may offer:

  • Optional donations (for example, via PayPal or similar platforms), and
  • Optional memberships or subscriptions that provide additional tools or features.

7.1 Payment processing

Payments are processed by third-party providers (such as PayPal or other payment platforms we may use). We do not store your full payment card details on Milivault.

Your use of a payment provider is also governed by that provider's own terms and privacy policy.

7.2 Memberships and subscriptions (future)

If we offer paid memberships or subscriptions:

  • The specific benefits, prices, and billing terms will be explained at signup.
  • Access to paid features may depend on your account remaining in good standing and your payments being up to date.
  • We may change membership features or pricing in the future, but we'll aim to give reasonable notice of any major changes.
  • Refunds, if any, will be handled according to the policy in effect at the time of your purchase or subscription.

8. Third-Party Sites and Content

Milivault links to and references third-party websites, including militaria dealers, auction houses, forums, and payment providers.

We do not control these third-party sites and are not responsible for:

  • Their content, accuracy, or availability
  • Their privacy practices or terms of use
  • Any transactions or disputes between you and a third party

If you choose to follow a link or purchase an item from another site, you do so at your own risk and under that site's terms.

8.1 Dealers and Rights-Holders: Corrections, Removal Requests, and Source Opt-Out

Milivault's goal is to help collectors discover listings and then visit the original dealer site. If you are a dealer, site owner, or rights-holder and you believe content appearing on Milivault should be corrected or removed, or you would like Milivault to stop tracking your site, you can contact us at milivaultweb@gmail.com.

To help us review quickly, please include:

  • The Milivault URL(s) (or item ID) in question
  • The original source URL(s) (if applicable)
  • What you are requesting (e.g., correct data, remove a specific listing, remove images, opt out entirely)
  • If you are requesting removal on behalf of a site or rights-holder, proof of authority (for example, an email from a domain-associated address)

We will review requests within a reasonable time and may correct information, adjust how listings appear, or remove content/source coverage as appropriate. We do not handle disputes in public comments or social media threads; please use the contact email above.

9. Intellectual Property

Unless otherwise noted:

  • The Milivault name, logo, design, and site code are owned by or licensed to us.
  • The overall look and feel of the site (layout, design, case study presentation, etc.) is our intellectual property.

You may use the Service for personal, non-commercial purposes. You may not copy, modify, distribute, or create derivative works from the site's code, design, or non-public content without our permission.

Product photos, logos, and descriptions from dealers, auction houses, or other third parties remain the property of their respective owners and are used on Milivault for informational and reference purposes.

10. Disclaimers

The Service is provided on an "as is" and "as available" basis.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including (but not limited to):

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy, reliability, or completeness of the information on the site
  • Continuous, uninterrupted, or error-free operation of the Service

We do not promise that using Milivault will prevent bad purchases, guarantee profits, or ensure that any particular item is original or authentic.

Nothing in these Terms limits or excludes any rights or remedies you may have under applicable law that cannot be limited or excluded.

11. Limitation of Liability

To the fullest extent permitted by law:

Milivault and its owner (Keenan Nilson) will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total liability for any claim related to the Service will be limited to the greater of:

  • the amount you have paid to us in the 12 months before the event giving rise to the claim, or
  • a reasonable minimum amount permitted by applicable law.

Some jurisdictions do not allow certain disclaimers or limitations of liability, so parts of this section may not apply to you.

12. Termination

You may stop using Milivault at any time and, if you have an account, you may request its deletion by contacting us at milivaultweb@gmail.com.

We may suspend or terminate your access to the Service (including your account) if:

  • You violate these Terms
  • You misuse the Service or attempt to harm it or other users
  • We are required to do so by law or for security reasons

Upon account deletion, your personal data will be removed in accordance with our Privacy Policy, though some anonymized data may be retained for analytics. Some information may remain in our backups or logs for a limited time.

13. Governing Law

These Terms are governed by the laws of Japan, without regard to its conflict of law rules.

If any part of these Terms is found invalid or unenforceable, the rest will remain in effect.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we'll change the "Last updated" date at the top. For major changes, we may also provide a more prominent notice (for example, on the site or by email).

By continuing to use Milivault after changes take effect, you agree to the updated Terms.
